Theft, or larceny, is fraudulently obtaining another person’s property, unlawfully converting another person’s property with intent to steal, or embezzle and hiding another person’s property with intent to convert and steal it (Mass. Gen. Laws Ch. 266 § 30).

Theft can range from petty theft to grand larceny. The severity of theft is based on the value of the property that was stolen. When the value is less than $250 it is considered petty theft and when the value of the property stole on over $250 the charge is grand theft or grand larceny which is often a felony charge. Unlike many states, Massachusetts law does not divide theft or larceny offenses into misdemeanors and felonies. Instead different rules apply depending on the value of property involved, the type of property stolen and in some cases who the victim is.
Most Massachusetts theft convictions are punishable by imprisonment for a certain period of time and are up to the judge’s discretion. Judges will take into account the total value of items stolen and circumstances surrounding the theft. However, if you are found guilty of a felony theft you can receive up for 5 years in prison and be fined up to $25,000.
